02 / From enquiry to agreement
We develop Shopify stores, business websites, custom websites and solutions with 3D and interaction. We offer services to both businesses and private customers.
An enquiry is non-binding and is not an order. A project requires a specific proposal describing the deliverables, total price, timeline and applicable terms, which the customer accepts.
These texts are a draft and do not themselves form a complete contractual basis.
03 / Scope and collaboration
The proposal describes the pages, features, design deliverables and integrations included. It also establishes who provides copy, images, product data and other content, and which feedback rounds are included.
Changes outside the agreed scope are discussed with the customer, including any impact on price and timing, before additional work begins. Customers must hold the necessary rights to materials they provide.
04 / Price and payment
Payment terms are awaiting company information. No deposit, instalments, payment deadline or fees have been set.
The specific price and all agreed costs must be stated before acceptance. Private customers are given the total price including any VAT and mandatory charges. A budget selected in the enquiry form indicates the customer's needs and is neither a price list nor a binding price.
05 / Platforms, hosting and chatbot
Domains, hosting, Shopify subscriptions, paid themes, apps and other external services are described separately in the proposal, including who pays for and manages them.
A chatbot is optional. Features, provider, data processing and any running costs must be clarified if the customer chooses one. Ongoing maintenance, updates and support must be stated in the agreement if included.
06 / Delivery and rights
The proposal sets out milestones, expected delivery and the customer's contribution. If a delay occurs, the cause and consequences are discussed with the customer.
Before work begins, the rights and source files the customer receives, the timing of handover and any components covered by third-party licences must be described. Approving a design draft does not remove a private customer's mandatory rights in relation to defects.
Conversion-focused design does not guarantee a particular number of enquiries, sales or search engine rankings.
07 / Private customers' right of withdrawal
For distance contracts for services, private customers generally have a 14-day right of withdrawal from the date the agreement is concluded. An enquiry does not create a purchase agreement.
Starting work during the withdrawal period requires a separate, express request. Payment for work delivered before withdrawal is subject to the statutory conditions and information requirements being met. The right of withdrawal does not end merely because work has begun; a fully performed service also requires the relevant prior consents and acknowledgements.
If a deliverable is legally classified as digital content or a digital service, the relevant rules must be clarified for that agreement. A custom website is not automatically exempt from the right of withdrawal.
Before private customers can place an order, the final guidance must include the contact address, refund information and model withdrawal form. Customers must receive the agreement and required information in a form they can save, such as email.
08 / Defects, cancellation and complaints
If a customer encounters defects, they must be able to report the problem using the final contact address. The solution is assessed against the agreement and the rules applicable to the deliverable.
Terms for cancellation, termination, any ongoing hosting and liability must be completed. This draft contains no automatic cancellation fee or limitation of liability.
A proposal cannot limit private customers' mandatory rights. The applicable complaints procedure depends on the agreement and must be stated in the final terms. See the official complaints guidance from Nævnenes Hus.
